Collection: Terms and conditions

OVERVIEW

This website is operated by Trustmade ApS. Throughout the website, the terms “we”, “us” and “our” refer to Trustmade ApS. Trustmade ApS provides a platform via this website, including all information, tools and services available from this website to you, the user, subject to your acceptance of all terms, conditions, policies and notices set out here.

By visiting our website and/or purchasing something from us, you use our “service” and agree to be bound by the following terms and conditions (“Service Terms”, “Terms”), including these additional terms and conditions and the policies referred to herein, and/or available via hyperlink. These Service Terms apply to all users of the website, including without limitation users who view content, as well as retailers, customers, shoppers and/or content contributors.

Read these Service Terms carefully before accessing or using our website. By accessing or using any part of the website, you agree to be bound by these Service Terms. If you do not accept all the terms and conditions of this agreement, you may not access the website or use any services. If these Service Terms are considered an offer, acceptance is expressly limited to these Service Terms.

All new features or tools added to the current store are also subject to the Service Terms. You can review the current version of these Service Terms on this page at any time. We reserve the right to update, change or replace any part of these Service Terms by publishing updates and/or changes on our website. It is your responsibility to check this page regularly for changes. Your continued use of or access to the website after the publication of any changes constitutes acceptance of these changes.

The agreement is entered into with Trustmade ApS, CVR 40320458, Helsingørvej 4, 7100 Vejle. You can contact us at kontakt@trustmade.dk or by phone at +45 69 16 41 64.

These terms and conditions apply to businesses that create a business profile or purchase a subscription from Trustmade. The person entering into the agreement must be of legal age and have the right to act on behalf of the business. The terms “you” and “your business” refer to the business with which the agreement is entered into. Customers who write reviews or use our complaint function are subject to the separate review rules. A general visit to the website does not create a subscription and does not constitute consent to marketing or the processing of personal data.

SECTION 1 – GENERAL TERMS

You must provide correct information about the business, its CVR number, domain, contact persons and billing, and keep it updated. We may request the documentation necessary to verify the business's identity and your right to manage the profile. A separate written agreement on price, features or other terms shall prevail over the general terms and conditions in the event that the agreement deviates from them. The data processing agreement shall prevail over the terms and conditions regarding the processing of personal data on behalf of the business. The review rules govern the publication and moderation of reviews. Trustmade or our licensors hold the rights to the platform's software, name, logo and design. You receive a limited right of use for the agreed features and approved widgets during the agreement period. Your business retains its rights to its own material. You grant us the right of use necessary to provide the platform and display the agreed business profile, including the business's name and logo. We may not use private customer lists solely for our own marketing purposes by reference to this provision. Reviewers retain the rights to their reviews. Our use of reviews follows the review rules. Submitting a proposal or a support request does not give us an unlimited right to publish confidential material or change customers' statements. In the event of a material breach, the affected party may demand that the situation be remedied within a reasonable deadline and terminate the agreement if the situation is not corrected. Any limitation must be necessary and proportionate to the breach. In the event of an acute security problem, illegal activity or serious manipulation, we may restrict access immediately. We will provide a specific reason and access to have the decision reviewed, unless the law prevents us from providing the information. A restriction of business access does not in itself result in the deletion of lawful reviews. If Trustmade ceases to provide a paid service for a period during which the business has paid and is entitled to the service, the business's claims will be assessed according to the agreement and Danish law. We cannot generally retain payment for services that we unlawfully fail to provide.

SECTION 2 – CHANGES TO SERVICE AND PRICES

We may correct errors, improve security and update the platform. We will inform you about planned changes that have a significant impact on your use. A material deterioration of the agreed features or a price increase during an ongoing commitment period requires a separate agreement with you, unless the change follows from mandatory law. New prices and terms apply to new agreements from the stated date. Changes for an upcoming agreement period must be notified directly, so that you have a genuine opportunity to consider and terminate before renewal. The notice period and the rules for renewal must be stated in the agreement overview, cf. section 5. A new version on the website does not in itself change an agreement already entered into. Changes are not retroactive. You will be notified of changes that affect your agreed rights or obligations.

SECTION 3 – PRODUCTS OR SERVICES

The subscription provides access to the features described for the selected package in the agreement confirmation. Features may include business verification, review invitations, widgets, statistics, re-evaluation and complaint dialogue. Add-ons and upgrades require separate acceptance if they involve a new payment or commitment period. Verification documents the circumstances stated on the business's verification page, for example, the connection between the business's registration and the associated domain. Verification is not a guarantee of the business's finances, delivery capability, all customer experiences or compliance with every legal rule. Your business remains responsible for its own goods, services, agreements and customer service. Trustmade does not become a party to the business's sales agreements with its customers. Prices for business subscriptions are in Danish kroner and exclusive of VAT, unless otherwise expressly stated. The price and payment period you accept at the time of ordering are stated in the agreement confirmation. FREE for e-commerce is free, does not require a payment card and has no commitment. FREE does not change to a paid subscription without your express acceptance. Core has an initial commitment period of 12 months by default, unless your written agreement states otherwise. The choice between monthly and annual payment does not in itself change the commitment period. The agreement confirmation must state the start date and the first date on which the subscription can terminate. For automatic card payment, the amount, payment frequency and rules for future debits must be stated before you accept the payment agreement. Payments are processed via the payment provider stated at the time of payment. Any payment fees must be stated before ordering. If a payment is missed, we will notify you and provide a reasonable deadline to pay. Lawful interest and fees may be charged according to applicable rules. Access may be restricted if payment continues to be missed after notification. A payment dispute does not in itself give the right to change or remove customers' reviews.

SECTION 4 – THIRD-PARTY LINKS

Certain types of content, products and services available via our service may include materials from third parties. Third-party links on this website may direct you to third-party websites that are not affiliated with us. We are not responsible for investigating or evaluating the content or accuracy, and we do not guarantee, disclaim, or assume any liability or responsibility for third-party materials or websites, or for other materials, products or services from third parties. We are not responsible for any form of damage related to the purchase or use of goods, services, resources, content or other transactions conducted in connection with third-party websites. You are asked to carefully review the third party's policies and practices and ensure that you understand them before entering into a transaction. Complaints, claims, concerns or questions regarding third-party products should be directed to the third party.

SECTION 5 – PERSONAL INFORMATION

The Privacy Policy describes the processing activities for which Trustmade is the data controller. When Trustmade processes personal data on the business's documented instructions, the processing is governed by the data processing agreement and the completed appendices.
Contact us at kontakt@trustmade.dk in the event of a disagreement about the subscription. We will first seek to resolve the disagreement through dialogue. The agreement is subject to Danish law. A dispute that cannot be resolved may be brought before the competent courts according to the general rules. If a provision cannot be enforced, the remaining provisions continue to apply to the extent that they can lawfully stand alone.

SECTION 6 – PROHIBITED USE

You must protect your access credentials and grant access to employees as needed. Contact us immediately if you suspect misuse of the account. You may not use the platform for illegal content, spam, harassment, fake customer experiences, rating manipulation, unauthorized collection of personal data, or attacks on the system's security. You may not bypass access restrictions or impersonate another business or customer. Widgets and badges may only be used for the business and domain to which they are associated. You may not change the display so that the status, rating or customer base appears misleading. If verification lapses, the display of a current verification badge must cease. We will provide a reason for a restriction and inform the business how it can have the situation reviewed.

SECTION 7 – LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTIES

The parties are liable according to the general rules of Danish law. Trustmade is not responsible for the business's own delivery to its customers. The business is responsible for its own legal violations and for material that it submits itself. We do not guarantee the truth of any review. We are responsible for our own handling of content according to the rules applicable to the service. A provision regarding third-party content does not exempt us from processing concrete reviews of illegal content. These terms do not contain a general disclaimer of all liability or an unlimited duty to indemnify Trustmade. Any separate limitation of liability must be clearly agreed upon and cannot override mandatory law or the rights registered under GDPR.

SECTION 8 – RESERVATIONS

In the event that it is determined that a provision in these Service Terms is unlawful, annulled, or unenforceable, such a provision shall nevertheless be enforceable to the full extent permitted by applicable law, and the unenforceable part will be considered separate from these terms, and such a decision will not affect the validity and enforceability of the remaining provisions.

SECTION 9 – TERMINATION AND RENEWAL

You can terminate by writing to kontakt@trustmade.dk with the business's name and CVR number. We will confirm receipt and state the termination date. You can terminate during the commitment period with effect from the first time the agreement allows termination. Stopping use of the platform, removing a widget, or disconnecting an integration is not a termination. Payment for the agreed period is due, even if you choose not to use the features. This does not limit your rights in the event of our material breach. The assessment of any refund follows the specific agreement and applicable law. Termination of the subscription does not automatically mean that public reviews or the business's public profile are deleted. The processing and deletion of information follow the Privacy Policy and the data processing agreement. The right to display a current verification status ceases when the conditions for verification are no longer met.

SECTION 10 – REVIEWS AND BUSINESS RESPONSES

Payment to Trustmade does not give the right to a specific rating, to have negative reviews removed, or to influence our moderation. The business may not select reviewers based on their expected satisfaction or make help, refunds, or other rights conditional on a positive review, a higher score, or deletion. The business can have a factual rebuttal published for a review without payment. If the response function is not available in the business's package, the rebuttal can be sent to kontakt@trustmade.dk with a link to the review and documentation that the sender represents the business. Additional tools for handling responses may be included in a paid package. The review rules apply to both reviews and business responses. A rebuttal may not publish the customer's private information or pressure the customer to change their assessment.

SECTION 11 – INVITATIONS AND CAMPAIGNS

The business must have a lawful basis for transferring customer information to Trustmade and provide customers with the necessary information about the processing. Only transfer the information necessary for the selected feature. Review invitations must be neutral when sent as service inquiries. Invitations that also contain offers, discounts, branding, or other marketing must comply with the rules on electronic marketing. A legitimate interest under GDPR is not in itself permission to send marketing emails or SMS messages. For campaigns, the recipient must have given valid consent, unless all conditions for the exception for own similar products to previous customers are met. Unsubscribing must be easy and free. Marketing consent may not be hidden in the terms and conditions. Recommendation features may not be used to send marketing to friends' or other third parties' addresses without the necessary permission. A reward for recommending the business does not override spam rules. Any incentives for reviews must follow the review rules.

SECTION 12 – OPERATION AND INTEGRATIONS

We work to deliver the agreed features and remedy material errors. The platform may be temporarily unavailable due to maintenance, errors, or security incidents. We will notify you of any significant planned service interruptions as soon as practicable. Any special requirement for uptime, response time, or support is only applicable if agreed in writing. We do not provide a general guarantee of increased turnover, more customers, or a specific rating. Integrations require the relevant access and any agreements with other suppliers. At the time of ordering, we state whether an integration is available and whether it requires manual setup or an additional purchase. A third party's terms do not exempt Trustmade from our own agreed obligations.

SECTION 13 – GOVERNING LAW

These terms of service and any separate agreements by which we provide services to you are subject to and interpreted in accordance with the laws of Denmark.

SECTION 14 – CHANGES TO TERMS OF SERVICE

You can review the current version of these terms of service on this page at any time. We reserve the right, at our discretion, to update, change, or replace any part of these terms of service by publishing updates and changes on our website. It is your responsibility to regularly check our website for changes. Your continued use of or access to our website or the service after the publication of any changes to these terms of service constitutes acceptance of these changes.

Rules for reviews, recommendations, and complaints

SECTION 1 – PURPOSE AND ACCESS

Trustmade allows customers to describe a genuine purchase experience or a verifiable customer relationship. Reviews are intended to help others assess the experiences of a company's customers. It is free to write a review. You do not need to subscribe to Trustmade or accept marketing to participate. When you submit a review, you confirm that you are describing your own experience and following these rules. You must not impersonate someone else or review on behalf of a fictitious customer. Owners, employees, and persons with a conflict of interest must not present a review as an independent customer experience.

SECTION 2 – VERIFICATION OF CUSTOMER RELATIONSHIP

We use information about the selected company, order or invoice number, and email address, as well as a confirmation code, to verify the basis for the review. We may request additional documentation if there is a specific doubt about the customer relationship. You should remove any information that is not necessary for verification before sending documentation. A confirmation code documents access to an email address. It does not alone document that a purchase has taken place or that all statements in the review are correct. Verification must be applied consistently to both positive and negative reviews. A company cannot reject a genuine customer experience solely because the customer is dissatisfied.

SECTION 3 – WHAT YOU MAY WRITE

Describe your experience objectively and as accurately as possible. Your assessments and opinions may be critical. Factual information must have a genuine basis. Write only about the company and customer relationship to which the review pertains. You must not submit fictitious customer experiences, advertisements, spam, threats, unlawful harassment, material that infringes on the rights of others, or irrelevant content. Do not include CPR numbers, payment card details, health information, private addresses, or other confidential information about yourself or others. Names and information about individual employees must be necessary and lawful to publish.

SECTION 4 – PUBLICATION AND RIGHT OF USE

Reviews may be displayed on Trustmade's public company pages and in associated widgets. The reviewer retains their rights to the text and grants Trustmade a non-exclusive right to display and technically format it as part of the review service. This right does not grant access to rewrite your opinion or improve your score. Your private email address, confirmation code, and private documentation must not be displayed as part of the review. If you insert private information into the text yourself, we may ask you to remove it or limit the publication of the affected information

SECTION 5 – RATING AND RECOMMENDATIONS

An overall rating must be displayed together with the number of reviews on which it is based and an available explanation of the calculation. A verification status, a rating, and a recommendation are different pieces of information and must not be presented as the same control.

SECTION 6 - INVITATIONS AND INCENTIVES

Companies may invite customers based on objective criteria, such as all completed purchases within a certain period. They must not filter customers based on expected satisfaction or deter dissatisfied customers from the public review option. If a review is submitted in exchange for a benefit, the benefit must be clearly stated. A benefit must not depend on a positive assessment, a specific score, or subsequent modification or deletion. The same terms must apply regardless of the customer's assessment.

SECTION 7 - MODERATION

We treat positive and negative reviews according to the same published criteria. Critical content is not removed solely because the company disagrees or pays for the platform. We may reject, limit, or remove content when there is a concrete basis for it being unlawful, not based on the required customer relationship, a duplicate under the published rules, constituting manipulation, or violating the content rules in Section 3. If in doubt, we may obtain relevant documentation and give the reviewer the opportunity to correct the issue. A lack of agreement between the parties is not in itself proof of a fake review. A limitation should, as far as possible, apply to the specific issue rather than the entire review. We do not change a customer's score or opinion on behalf of the company. If it is necessary to remove private information, the change must be made without altering the meaning of the customer experience.

SECTION 8 - REBUTTAL AND RE-EVALUATION

The reviewed company has access to a factual and free rebuttal of the review. This can be done via the platform or by sending a response to kontakt@trustmade.dk with a link to the review and documentation of the sender's affiliation. The response must follow the same rules regarding lawful content and private information. A re-evaluation gives the customer the opportunity to voluntarily update their experience, for example after an issue has been resolved. The company must not write the change for the customer or require an improved assessment as a condition for fulfilling the customer's rights. The customer may retain their original assessment. An update is handled according to the published method for rating and history.

SECTION 9 - MODIFICATION AND DELETION

If you want to correct or request the deletion of your review, you can use the available feature or contact kontakt@trustmade.dk. We may request the necessary information to verify that the request comes from the correct person. Requests to delete personal data are assessed according to the GDPR and the privacy policy. A terminated company subscription is not an automatic reason to delete lawful reviews. Private documentation may be stored separately when necessary and lawful, for example in connection with a specific dispute.

SECTION 10 - REPORTING UNLAWFUL CONTENT

You can report content that you believe is unlawful to kontakt@trustmade.dk. Provide the exact link or another identification of the content, the reason it is unlawful, relevant documentation, as well as your name and email address. Confirm that the information is correct and complete to the best of your knowledge. We will confirm receipt if you have provided a contact address, and we will process the report in a timely, careful, and objective manner. Affected users will receive a clear reason for a limitation where the rules require it. The reason will describe the relevant content, the factual circumstances, the basis in law or terms, and the available options for challenging the decision. Contact point for users and authorities regarding the platform and content: kontakt@trustmade.dk. You can write in Danish or English. The inquiries may be handled by an employee.

SECTION 11 - COMPLAINTS AND DIALOGUE

You can complain about our handling of a review by writing to kontakt@trustmade.dk with the decision, the relevant link, and the reason for the complaint. We will re-evaluate the case and provide a reasoned response. A complaint is handled free of charge and in a manner that does not depend on a party's subscription or rating. A complaint about a purchase from the reviewed company is a separate matter from a complaint about Trustmade's moderation. Our complaint function can help the parties exchange information and find a solution. Trustmade does not determine the parties' legal rights as a court or an approved complaints board. Use of the complaint function does not change deadlines or the possibility of going to a relevant authority, a complaints board, or the courts. Complaint dialogue and private attachments are not published as reviews. If a customer later chooses to write about the experience, the review must follow these rules, and the display must be explained before submission.
